Gun Owners: Unify ... or Perish

Posted in: CRPA
If only we lived in a perfect world. We do not. Our reality is marked by struggle in a fight where reason and common sense have no relevance to our tormentors. The facts are inconveniences that are twisted to suit the whims of our adversaries and junk science is taken as fact just as alchemy was in 15th century France. California is the front line in that struggle. It always has been. As far as the anti-gunners are concerned, as goes California, so goes the rest of the country. California is where we must hold.

The Freedom to Carry Issue....continued

Both Alan Korwin's "Freedom to Carry" article and Jerry Frendian's rebuttal in the The Firing Line mag¬azine were read with great interest. I would imagine that Mr. Korwin's pro-firearm "Freedom to Carry" piece alone would be enough to launch the California State Legislature through the proverbial Capitol dome roof like the space shuttle.

After Winning McDonald v. Chicago: What's the Real Story?

I want to spend a moment discussing what will happen next, assuming that in late June the Supreme Court holds that the Second Amendment applies to states and local governments.

CRPA :: Resisting Tyranny - What Is The Real Story?

Posted in: CRPA
Often lost when we talk about the right to keep and bear arms is its prophylactic effect on freedom and our Republic. This is also a sensitive topic, as nothing else seems to bring out the extremists on both sides of the gun debate more than talking about how the right to arms ensures freedom. However, the right to arms to resist tyranny isn't just something last utilized in 1775 and whose effects are historical anachronism. I want to high¬light two often-overlooked modern incidents that remind us why the right to keep and bear arms protects our Republic.

Ethical violations and arrogance may lead to the demise of the Second Amendment: The Next Arms Race

"Lawyers are a prudent race though not very fond of liberty" - Ralph Waldo Emerson

December 15, 1791, after two years and six months of debate, the Virginia General Assembly ratified the Bill of Rights, adding, among other things, the Second Amendment to the United States Constitution:

A well regulated militia being necessary to the security of a free State, the right of the People to keep and bear arms shall not be infringed

And for the next two centuries, nothing really happened with the Second Amendment.

Incorporating the Second Amendment: What is the real story?

Posted in: CRPA

The primary issue that remains before courts begin to strike down unconstitutional state and local firearms laws is "Incorporation." This is the legal term for applying our rights against the Federal government, including those that are spelled out in the Bill of Rights as well as those that have not been enumerated against the States through the Fourteenth Amendment. With the Supreme Court recently deciding to review McDonald v. Chicago, some explanation of the history and original popular understanding of the 14th Amendment is important context as the case moves to oral argument in February 2010 with a decision expected in late June 2010.

Believe it or not, you can buy a brand-new and legal semiautomatic “AR" or "AK" style rifle in California! A lot of people think that the California "Assault Weapon" ban prevents you from buying those types of rifles, but they are flat wrong.

A Loaded Firearm in California- What is the Real Story? - CRPA

Posted in: CRPA
One of the issues that generate a large amount of confusion is the simple question of what is a "loaded firearm" under California law. Unfortunately, in the recent past many California law enforcement agencies were not current on the state of the law and have spread misinformation on their websites and in their officer training. I want you to be able to take your gun to your office or the range without worrying about running afoul of California law and without any fear that you are improperly transporting it.
